Looking for advice on the relevant court procedures that apply please.
I have an appeal in process to the Upper Tier Tribunal regarding the closure of a child maintenance case due to my ex taking my daughter abroad and thus being outside the jurisdiction of the CMS.
I have now received detail of an appeal to the Lower Tier for the same case, from my daughter's mother, asking the court to review the current rate of payment calculated by the CMS.
If my Upper Tier appeal is successful, then the CMS case will close and the Lower Tier appeal from my ex will be null and void.
Is there a defined court procedure for these circumstances? i.e. effectively put the Lower Tier appeal on hold until the outcome of the Upper Tier appeal is known?
Should I write to HMCTS and request that this process is put into effect?
