• Caught Shoplifting - Letter From RLP? Help please!

Hi,

I've read a few threads that relate to my situation however I thought it would be best to get a more onerous opinion instead.

The following occurred in Scotland btw.

Recently I was ultimately caught shoplifting from Boots, however this was a crime I had not intended to commit. Long story short I walked out
the shop unintentionally with unpaid goods which was due to time restraints as I was due to meet someone however was caught in boots
waiting on a prescription. Hence why I walked out the shop without paying. I was stopped by security and led into the security room at the back (along with the person I was accompanied shopping with). Security explained I/we had shoplifted etc etc before tallying up the stolen goods which amounted to £188.00 (3 bottles of aftershave/perfume). The
police were called and we were charged. Although I explained it was unintentional and I had means to pay (I even offered to pay but it was refused), they were having none of it and explained that a crime had still been commuted and due to the value of the goods, this was why we were being charged. I accepted the charge and that was the end of it in the sense of the police. I was given a letter from the security guard in boots stating that a company called 'RLP' would be contacting us regarding seeking 'losses' on behalf of Boots. After reading some of the other threads I know that this company RLP can be some what tricky to understand. I received my letter 1 week later and they are asking for £258 to cover said losses. All 'stolen' goods were retrieved that day, still in sell-able condition (the goods had only
previously been put in my bag before being retrieved again by the Security). I can post a picture of the letter if that would be any help to getting some advice.

Do I need to pay this money to RLP? Or should I pay?

The person I was with also received a letter demanding £258.

The figure they are asking for seems way to high considering the goods can still be sold?

I know that they can take me to civil court but from what I've easy previously that is a rare occurrence?

I understand many may find the 'unintentional' alibi a cover up for my actions but I know it is the truth so please don't give me any judging comments.

Any help would be appreciated as I'm getting myself a bit worked up over this.

I've seen some really helpful advice on other threads however just looking for some advice relating to me.

Would really appreciate it.

Thank you in advance!

The advice is still ignore. There has been no loss. The goods were recovered and the security staff were doing what they were paid to do so absolutely no loss.

Ignore this letter and the subsequent letters that will be threatening even more dire consequences. If they are claiming £516 for losses (you and friend) what the heck does that represent? The security staff must be being paid a lot more than the minimum wage !

You may care to read the judgement in the Oxford case where RLP and the company that employed them got thoroughly spanked by the judge.

Hi and welcome

You say the police were called and you were charged.
Are you being prosecuted and if so have you been given a court date?

Regarding RLP, you and your friend should ignore them as ostell.
Look here if you want to see in advance their "scary" letters: http://legalbeagles.info/forums/show...=scary+letters

I have seen a few people on previous threads refer to the oxford case as RLP were thrown out by the judge.

Thank you for the reply.

des8, i couldn't tell you. All i know is we were charged and that was that. I haven't received any correspondence from the PF as of yet. The Police Officer on the day said he reckons we should both get a warning as it is a first time offence.

Re: Caught Shoplifting - Letter From RLP? Help please!

Hi, just an update so far on the situation. Myself and friend received our second letters as expected from RLP. This letter basically replicates the originally saying we still owe £258.88 each. However both letters now go into more detail about the event that happened i.e that we placed items in the bag and that the police were called and we were charged so somehow that implies that we accept guilt and should be paying this fine? As well as this is later goes on to say that we should get legal advice from someone professional and not the likes of Internet forums (most likely referring to this type of webpage). Now as well as this, the person I was with at the time was under the age of 18 therefore they have written to them differently to me. They are saying that because they are a juvenile they may not understand the severity of the situation and if they do not reply in 21 days (which is different from myself as I have only been given 14 days to settle payment) they will be writing to this persons parents? Is this allowed? My friend is a bit worried but I have assured them that this is a scare tactic and that we don’t need to pay. Would the advice still to be to ignore these letters? I just have this idea in the back of my mind that out of all people me and my friend will end up being the ones who actually get taken to court! Any help would be appreciated as before. Thank you again.

Is there any chance we can see copies of these letters please jh0023?? We can add them to our 'scary letter' files

Did you have any more contact with the police over this??

I'd still suggest ignoring ... rlp are not going to take you to court (only the shop/Boots can do that). They really shouldn't be threatening to write to your friends' parents either . Did they include a copy of this document (see attached) in their letter to your friend??

Re: Caught Shoplifting - Letter From RLP? Help please!

My advice would be to continue ignoring.

Look at this way.
If you ignore and by some freak of nature RLP persuade Boots to initiate court proceedings, what will happen?
Following the Oxford case the chances are you would win ! and if you lost you pay RLP's invoice plus very limited costs.

Really can't see why you would even contemplate paying.

Regarding your companion: the threat of RLP writing to his parents is real.
RLP should not contact them. but they will under the guise of pretending he does not understand the "seriousness" of the situation and they are concerned for his wellbeing.
All they are really concerned about is obtaining money, and will try and obtain it from them.

Obviously I do not know the full situation, but generally would recommend the young person talks to parents, as notification by RLP will be a bit of a shock.
From your account it would seem that the youngster is being chased on the basis he was associated with you when you had your memory lapse.

I guessed that the general advice would be to ignore. My friends parents already are aware of the situation but as you can probably tell the thought of a company looking for money threatening to e-mail your parents has frightened them a little.I appreciate all the help, been a big help in putting my mind at ease. Thanks again!

Standard threats and I see they still leave out the most important option open to you...... ie ignore them

Hi, I’ve attached the photos that my friend received regarding the above incident.

We are continuing to ignore RLP as per the advice above. I will post the following letters when we receive them.

We have both still not received anything from the Police so I will update when and if we receive anything both from the PF or the Police.

Just want to say a massive thanks so far to everyone that has helped with advice, can’t express how much it has helped us so far.

Thanks

When the police dealt with the matter, can you remember exactly what they said?
Did they give you anything?
Did they caution you before questioning you?

You say you were "charged"...... were you given a charge sheet?
