If the intention is to spoil the frozen fish and food, then it is CD, Wales. Sounds a bummer, I know, but that's English Criminal Law for you. If Tesco pass the OP's girlfriend's details to RLP, I would be inclined to complain to the ICO for -

a. improper disclosure to a third party;
b. disclosure without consent;
c. failure to notify use of data; and
d. misuse of data.

Given the unlawful actions of the security goon and manager, any claims by RLP that the OP's girlfriend's detention was lawful, should be good reason to put them and Tesco to strict proof. An anti-harassment warning letter would be justified, given the circumstances.

With CD, Wales, you need only prove the defendant was reckless as to whether property was damaged or destroyed. The statutory definition of CD makes provision for deliberate and reckless damage or destruction.

Either way if RLP invoice her, they could be invited to do an Arnie as in "Sue me dickhead" I'm sure they and Tesco would regret it, it might even blow a hole right through RLP below the waterline and finally sink the cupid stunts.

I think RLP are more likely to start the chain of letters from them and a DCA to try and get the FINE Ha Ha paid stopping short of court action they I expect believe they can take this action as we read so many times on here these letters get people worried and stressed.

Hopefully they will refer to their invoice as a FINE when they do try court again and they are told that as they are private organisation thety cannot fine anyone and are laughed out of court with costs awarded against them.
