It should be enough to give them something to think about and remind them of their legal obligations. If they then ignore and continue as before, it would IMHO be an indication of the veracity and validity of their claims and demands.

Eloise would probably be the best person to answer that question, Inca. However, if the Loss Prevention goon has been a tit, it could come back and bite Game on the bum, not the OP. However, without seeing what evidence CRS and Game are relying on, it is difficult to say.

Quite likely. I wouldn't be expecting a queue around the block of potential employers, that's for sure. Being dismissed (IF he was dismissed - it would be wrong to assume that he would be) isn't a great recommendation but at least it gives you the chance to put your own version of events. In the eyes of the world, resigning is a confession and few employers are then going to believe your version of why you really didn't deserve what happened.

Re: Caught Stealing from Work, Letter from CRS

Will this suffice as my letter? Taken from the template by Amethyst.

          Dear Victoria Jones,

Thank you for your letter, a notice of civil claim, case number 137804.

It appears you are non-compliant with civil procedure, in that you have failed to state a discernible case against me and you have failed to show me the documents on which you intend to rely. That is to say, your letter discloses no evidence and no case. Your letter also is not a Letter of Claim.

Until and unless you comply with civil procedure by providing a heading "Letter of Claim" AND disclose all the evidence on which you intend to rely AND disclose your legal case, as is required by civil procedure. Please consider this a Subject Access Request (SAR) under Section 7 of the Data Protection Act 1998. I am not only unable to respond but quite unable to understand why you are making these demands.

Further, you make unlawful threats against me, which as already explained fall outside of legal protection. I reserve my position as to whether I will pursue you, and/or your "client" (assuming it is true you act for them), in the criminal and civil jurisdictions.

          Yours

Re: Caught Stealing from Work, Letter from CRS

It is my understanding that the Disclosure Provisions of the Civil Procedures Rules supersede the Data Protection Act and, so, it should not be necessary to submit an SAR. If anyone knows differently, please say so.

                Can anyone clarify?

I would like to see what they hold on me, how should I do this?

Try this amended version of the template letter in Post #79 -

                  Dear *************,

                  Your Ref: XXXXXXXXXXXXXXXXX

Thank you for your letter dated [date], in which you claim to act for [name of retailer] and make demands for payment in the sum of [amount].

It appears you are non-compliant with Civil Procedures Rules, in that you have -

                  a. failed to state a discernible case against me; and
                  b. failed to show me the documents and other evidence on which you intend to rely.

Furthermore, your letter discloses no evidence and no case and is not a Letter of Claim.

You are put on notice that until and unless you comply with Civil Procedures Rules by providing a heading "Letter of Claim" AND disclose all the evidence on which you intend to rely AND disclose your legal case, as is required by Civil Procedures Rules, I am not only unable to respond, but quite unable to understand why you are making these demands.

You are further put on notice that you make unlawful threats against me, which fall outside of legal protection, and I reserve my position as to whether I will pursue you, and/or your "client" (assuming it is true you act for them), in the criminal and civil jurisdictions.

You have 14 days in which to comply with my request for you to provide ALL evidence on which you intend to rely AND disclose your legal case AND a "Letter of Claim".

                  Yours

Let other LB members check this, but CRS are certainly non-compliant with CPR. If they fail/refuse to comply with requests for evidence, proof of case and Letter of Claim, it could have legal implications for both CRS and Game.

Cheers guys, left the bit in about CPR Pre-action protocol - and im sending the letter off today.

Heres a question - is Game now not heavily involved? I am solely dealing with CRS now?

Wise addition, Charity. Let's see how CRS react.

In answer to your question, Game engaged CRS and, as such, are 100% liable for ALL and ANYTHING they do or say in connection with this matter. So, let's just say, for example, it transpires you have a strong case against Game and CRS for harassment, under the Protection from Harassment Act 1997, both of them can be held to account as there is provision in the Act to deal with those who aid, abet, counsel or procure others to engage in conduct amounting to harassment on their behalf.

Don't be too negative. If it transpires Game and CRS have done things they should not, you may be in a position to recover that amount.
