If such a libel case happened they would have too prove that the data subject committed the act with the intent to do so.

Also as the database is ran by cireco limited, then the more important question is are they themselves registered?
    No.

Nor should they be, as a database of accusations cannot possibly comply with the principle that data are fair and accurate. It is absurd for them to cite section 29 of the Data Protection Act 1998 (link) and claim that it grants them immunity, as it plainly does nothing of the sort.

On scanning the letters yesterday - a service which I'd be happy to perform for anyone - I was astounded by the cheapness of the stationary from RLP. The letters were printed on photocopied stationary; that is, the original seemed to have been printed professionally but had then been photocopied to give cheap copies of their printed stationary. It rather looked like what one might expect from a company that was too mean - or too skint - to buy any more printed stationary.

Had I not used the photographers' trick of placing a sheet of black paper over the letter on the scanner, the reverse side would certainly have been quite visible.

      Re: wrongful Act

Totally agree with you CC. Section 29 is ment only for the recording of criminal records therefore only applies to data where the subject has been convicted in my honest opinion. And is and should only apply to police records and CRB not to private limited companies, who really have no legal right to such information let alone any right to process peoples information based on accusation alone.

Nor are they a "relevant authority" as defined in that section.

          Re: wrongful Act

Many thanks for your diligent research, Teaboy. I've just had a look at what Cireco do and it has all the hallmarks of the illegal database held by the Economic League and similar databases. No private company would have access to terrorist files for employment screening purposes. Not only is access to such files subject to high level security clearance, very few people are allowed to have access to them. Even then, access is on a "Need to Know" basis.

Reporting RLP and Cireco to the OFT and ICO is now a must. If there is any evidence of security being compromised, then the police may need to be informed.

Just goes to show how companies regurlary class themselves as above the law. I suspect that RLP will likely go the same way as ACS Law, i.e. Bankrupt lol

                  Re: wrongful Act

There is a similar thread to this one where I have advised the OP to make a formal complaint to the SRA, which is what Richard Dunstan at CAB is now doing with RLP cases. It appears the SRA are a better watchdog than the government-backed ones. I am waiting for Richard to email the name of RLP's solitary in-house solicitor to me, then the other OP can file their complaint. If the OP on this thread wants to do the same, I will gladly provide them with the necessary details. I'm also going to see if Richard Dunstan knows about Cireco. I have to agree with Teaboy that RLP and Cireco are likely to go the same way as ACS Law.

Sure will. The sooner RLP and Cireco bite the dust, the better. In view of what Cireco say they'll do and the scope for blackmail, I feel the ICO needs alerting about their services. It will be interesting to see if RLP can hoodwink ICO as easily as they hoodwinked OFT.
