            Thank you both (Righty and Tuttsi) for your messages last night. Sadly I fell asleep due to continuing and prolonged brain-ache and only found them when I woke up at 4am this morning! :yawn:
            I'll go into town today and see if I can find a nice kind person who'll help me scan and email all three letters to you and when I get home I'll let you both know - on here - if I've been successful. I've blanked out my name etc on them, and written on my user name instead. If you need any more info please get in touch again, as I'll be at home for the rest of today.               To anyone reading this in the next few days, there's going to be a piece about so-called "Civil Recovery" on 'Watchdog' on Thursday 14 April. I don't suppose they'll be able to do too much about it, but it might be worth watching - even if it just reminds you that you're not alone..... :behindsofa:

                  Hi,

                  I found this thread as was looking for some info on RLP after being accused of shoplifting from a major supermarket chain.

                  What happened:

                  I had gone in to purchase some items but after getting confused / distracted at the automated tills walked out without paying. After being brought back into the shop I paid for my items and was expecting that to be the end of it.

                  I was then accused of shop lifting despite obviously going the motions of intending to pay in the first instance then paying when I returned.

                  I have contacted customer services who have said they will ring me back (twice and never have).

                  At the time I simply wanted this to go away but am now getting angry, the manager & security staff humiliated me and customer services are not answering my case.

                  Does anybody have advice on how I should proceed, am concerned that once RLP get hold of the claim that it will not matter to them the circumstances of the incident.

                    As you paid for the items there is NO case for you to answer & the Tesco Staff, by their conduct, have left Tescos wide open to litigation

                    Write asap demanding that they preserve the CCTV & don't take no for an answer If they say they destroy is after a few weeks remind them its a criminal offence to destroy evidence & if they do you will report them to the police

                      I have asked today for the CCTV and they have refused, am pretty sure they will not want me to see it as the CCTV will show I made an attempt to pay by scanning in the items.

                      I have spoke to customer services & explained my being autistic & they have advised me to get a lawyer.

                      Does anybody have any suggestions?

                        Hi Jared

                        Righty has asked that you write to them - do not phone, keep everything from now on in writing.

                        Basically, if they do not have CCTV then they have no evidence and if they have the CCTV then as you say it would show clearly that you did not intend to defraud them and that you wanted to pay. You need to demand that they send you that CCTV recording. Once you have that we can go to stage 2.

                          Hi jared,
                          Turn the tables on them - send them a Subject Access Request DEMANDING that they give you a copy of the CCTV footage. (It will cost you a tenner, & get proof of postage).
                          They have to provide the evidence, or a good reason why they cannot (That's going to be difficult for them, as they are 'contemplating' legal action & so have a duty to secure evidence), & they have to do so within 40 days!

                              Thank you for the advice, have spoke to customer services after they refused to let me watch the CCTV (and before reading your reply) they advised me that I should contact a solicitor.

                              Not sure if I should go down the route suggested or just let a solicitor deal with it, have looked into the DDA and am pretty sure they have broken it.

                                If the relevant date was after October 2010, I think you'll need the Equality Act.
