  • Primark shoplift caught/ DBS worry

    Hi,

    a couple years ago I was caught shoplifting at Primark and was taken into their little room where I had to fill out a paper with my address and name details. It was for approx £38 and first time offense.
    the manager came and spoke to me and I was really nervous and asked him about a criminal record and he said nothing would go on my record (he promised but not sure what to make of it) as a result of that. There was an officer in there but I believe it was for someone else and I never interacted with him
    i was then told by him that I will be sent a fine that I’d have to pay.
    The address I gave, I moved out from a week later and so have not received anything and no police have come after me since.
    my question is, will this issue show up on an enhanced DBS check for a job I am applying to?

    would really appreciate any advice here as it’s stressing me out.

    No. To get a criminal record you have to be prosecuted and convicted by a magistrates court. That did not happen to you. You weren't prosecuted or convicted so you don't have a criminal record. If you don't have a criminal record it won't appear on a DBS.

    The so-called "fine" wasn't a fine at all - only courts can impose fines and only if you are convicted. It was some private company that tries to get you to pay Primark's internal admin/staff costs of dealing with the incident. They have no legal right to make you pay it and we advise people to ignore their letters. Which in this case you did!

      Thank you for your response! My question is that is there a chance the police may have sent me a fixed penalty notice to that address which I may have missed? I have heard that an enhanced DBS may show such and may show if Primark reported my info to the police after I left?

      I returned all the stuff to them in saleable condition and never was spoken to by the police officer despite them being I. The room.

        No. The police don't just send you a penalty notice in the post because Primark reported you. You'd have to be interviewed by the police under formal caution and agree (by signing it) to accept the Penalty Notice as an alternative to prosecution.

        The police were never involved in your case so you can't have a FPN and are worrying unnecessarily.
