Original signature on letter before claim - does it matter?

Hi Guys

Just a quickie question.

I live abroad and was intending to take someone to court through mcol. I did intend to email a signed letter of claim to my parents in the uk for them to print off and post for both speed and ease.

However just had a thought, does the signature have to be an original given this is a legal document?

If you are claiming through MCOL then it is all done online and no way to add a signature.

Or is this a Letter Before Claim? Do you have access to a scanner? Scan your signature and add it as an image to a Word document or make use of the "add signature" function of Adobe PDF viewer. Black pen on white paper seems to work best.

You do plan to be back for the case itself?

Yes it is the letter before claim. I can sign it, scan it then email it to my parents, if that is acceptable.

No I don't plan on being back for the case and intend to get local legal representation.

A Letter Before Claim is not a court document so your 'wet ink' signature is not paramount.

However you would need to sign any court documents such as a Directions Questionnaire and Witness Statement.
