  • Stinky Case - Suing council for 'contract breach/negligence' What are my options?

    Hello everyone!

    The problem I'm having may seem to be shallow or simply not worth doing anything about, but I personally feel somehow ignored and let down by the local council, and also I believe if we allow them people to do what they want it can only get worse.

    Basically last Friday I was supposed to have my waste bins emptied. I took them to the front of the property as usual, only to find out later that Food Waste bin and Recycling Bin were emptied but General Waste one wasn't. So I rang up the council to report missed collection, and I was told that this will not be done up until the next scheduled date ( that is 2 weeks time, and what I am supposed to do with stinky bin for all this time in all current heath, still having current waste to add up, I do not know ) simply because MY BIN WAS NOT PRESENT FOR COLLECTION. And that is where the fun begins, but cutting long story short, waste company decided not to take them at this occasion because they were in incorrect place ( 4feet inside from the edge of the property - however other bins including recycling were left in exactly same place next to each other and waste company had no problems with emptying them due to some reason )

    I have been living in that property for last year and always leave my bins in same spot - I wouldn't leave them on the edge of the property as this would block my driveway, so for my convenience I used to leave them 4 feet in the property on the alleyway in between houses. There was never any problems with it, up until last Friday. I was led to believe that the spot is correct, I never had any information from the council telling me that it is not, but out of a blue I am punished by being left with that waste and you all can imagine how nice it is now around smellwise considering recent heath. I have been trying to explain that to the council, they said they will look at it , they even sent a man who actually admitted waste company was wrong and promised to arrange clearance, but nothing happened.

    I really believe I do not pay £165 a month to be treated in this way, I believe I have a right to be told if I do something wrong before I get treated this way and punished for doing something I wasn't even aware I do wrong ( and I'm still not )

    Finally it is not a rant about a rubbish bin, but Council really showed no interest in solving this issue that is why I feel ignored and neglected, and simply upset about the treatment I have received.

    Based on all the above I was thinking to get a private company to take the waste for me and bill the council for it, do you think I would have any chances of successfully doing that and if not, what other options I have?

    All the Councils I have been under only take bins left outside the property you only option is a formal complaint do not see you achieving much though.

      Ok.
      This is where I was placing my bins for the last year, as well as the last time where they did not take them saying they were not where they should be.
