Hi was just seeing if anyone had any input to my position here I know to some people it will be my fault that Im a problem gambler but looking for advice please.I recently re-opened my account on bet fair after self exclusion then after a couple of weeks was told due to having duplicate accounts one blue Square which was still under exclusion that my account would be shut.my issue is if I was not meant to bet yet they allowed me to re-opened my account I should be due a refund for all the money lost over the last few weeks I then replied telling my problem again on live chat with my argument being that I was allowed to re-open my betfair account which I did but then betfair self excluded me saying I was self excluded via blue Square therefore I shouldn't of been able to bet but i was so I want refunding as they let me open a self excluded account when this has happened before others have been refunded as the bookmaker has a duty of care. When telling betfair this they have changed there mind and said all blue Square accounts were allowed to be reopened yet first time they said it wasn't so I'm at a loss and they won't show me where in their terms it says this. I was just wondering if I keep emailing betfair with more information or need to go elsewhere as they won't reply. Any help would be greatful and if anyone can think of anything else to write. I would like to make it clear that I haven't looked to deceive betfair and know I've lost looking to re-claim I generally feel that I was given wrong info that led me to a loss when a duty of care was owed thanks

That is not an answer to my question but the bookmaker wouldn't of paid out if I had of won as they do checks before a withdrawal can take place like I said before I haven't gone out of my way to de fraud them it was a genuine request to see if I could re open my account and I shouldn't of been able to I'm looking for sensible legal advice not little remarks about my character thanks

As you have admitted having a problem with gambling, I do have some sympathy for you.
I assume you had two accounts with Blue Square (who are now part of Betfair)
You self excluded on both of these, but after 6 months applied to reactivate one.
Presumably you had to pass their vetting process before the account was reactivated.
Having lost you feel that as you still had a dormant account Betfair should not have reactivated your account.
However , you managed to convince Betfair that you were able to bet sensibly, so I do not see how you can have any claim against them.
The Gambling Commission puts the onus of staying with the exclusion agreement on the gambler, not the operator, so I do not see you having any success in reclaiming your losses, other than through a goodwill gesture by Betfair

I had excluded from betfair for a year I think in say 2010 and bluesquare in 2011 but that was indefinitely.my issue is that after two weeks of re opening betfair I was speaking to them online in chat and they said as you are self excluded from blue Square that means your self excluded from betfair

All I did to re open it was ask am I allowed to have my account opened and they said yeah but then two weeks down the line said I'm not allowed it due to being excluded on blue square

One could argue that Betfair are behaving responsibly, in reapplying your exclusion on realising you still have another excluded account.
You admit to already losing in the first two weeks: do you feel Betfair should continue to allow you to lose?

I'm sorry to say that Calvert v William Hill would appear to put the kibosh on any legal claim (the circumstances are not entirely dissimilar to yours as described above).
