  • Second Hand Car Problems

    Hi I don't know if anyone can help me.
    I purchased a car 21st Feb 2015 yesterday whilst taking my children out I parked the car up to find a cloud of smoke and the rear passenger side wheel almost on fire.
    The clutch of this car has begun slipping too. Ive taken this back to the garage and just received a phone call to say the brakes have been rectified. But they do not know if there is anything they can do about the clutch business. Any advise before I go and collect the vehicle would be very welcome.

    Presumably this was a used car purchased from a garage.
    If so the Sale of Goods Act 1979 applies and the car must be of satisfactory quality, fit for purpose and as described.
    The clutch is faulty (probably worn out!) and as you discovered he fault within 6 months you can request they repair it.
    It is up to the dealer to prove the vehicle was satisfactory when you purchased it. They need to prove the fault wasn't present by using evidence such as an independent report into the car's condition

    How did you purchase the vehicle? If you used a credit car or Hire Purchase you may have a claim against the financiers.

      Additionally the clutch problem may well have been brought on by the seized brakes putting undue strain on it.

        I collected the car the garage owner has replaced the calipers on the rear brakes I'm told. He's still refusing to do anything about the clutch or investigate the issue. He said he won't do anything as it's ok changing gears and only judders while creeping/stuck in traffic. So according to him as long as I don't get stuck in traffic I'll be ok.
        I obviously pointed out I didn't buy a car in the hope I never got stuck in traffic.
        But have no idea what to do now :/

          So it is not necessarily a slipping clutch, but juddering in 1st (and 2nd?) gear at low speeds.
          This could be due to a number of things eg loose engine/gearbox mountings, oil on clutch, misfiring.
          It needs diagnosing!
          Tell the garage that if they don't sort the problem you will either have it done elsewhere and sue them for the cost, or reject the car and get your money returned

            Juddering only in first. I know nothing about cars tbf. No error lights showing. And the problem seems to be only when the car is creeping along ie. Stuck in a traffic jam. I look like a learner kangaroo hopping along.
            I think I'll take it elsewhere and see what they say the problem is and go from there.

              Good luck, but don't allow it to drag on too long, as your rights change after 6 months.
