I regularly make and receive Part 36 offers but have never come across the other side prompting me to make an offer to them.
Given that it only has costs consequences and given the lack of costs in the small claims track, it is pretty much an irrelevance in any event. That is why, as nem, has already said, it doesn't apply.
Have they got, erm, actual solicitors acting for them or are they having a dabble and thinking they are being clever?
