  • Banned from tk max

Hello, today I went to tkmax and tried some tshirts out of which I have only bought only one. 2 Minutes after leaving the store, two guys started running towards me and asked me to go with them for a chat, because I know what I did. I went with them in a room, and one of them was quite agitated and told me that I have to acknowledge the fact that I have change the prices of some t shirts, otherwise they will get the police involved. I kepts saying no, but the guy was really agitated and he said that will be easier to admit rather than calling the police, because we will spend hours in there. Because I had to submit a report in the morning had no time to sleep, and because I am a foreign student and I am not aware of the procedures, I said ok just to avoid getting to deal with the police. I have told the guy the there is no problem, I can pay the ''real price of the t shirt'' and he said that is to late for this, and is beeter to admit that I changed the prices. After saying yes, just so I can get escape from that nightmare, he told me that I have to sign a months Banning form. I have read the form and there wasnt anything stipulated about any action, beside giving back the item, which I did and received a refund. After leaving the store, I have noticed that there is another page where it says that they might seek for further charges for the investigation, and if I don't comply, action in court will take place

    First Question:

Did you actually change the price on the T-shirt?

Be honest with us, as we can only help you if your honest about this to us - No one here will judge you if you did actually change the prices anyway.

      Hello,

Thanks for replying to my thread. No mate, I haven't... I just went there with my girlfriend to get her a birthday present, and while she was looking in the ladies section I went upstairs to the men... and grabbed some t-shirt, out of which some were on sale, after which I had a look around the store, met with my girlfriend...and straight to the fitting rooms... and pay after ....that was it

In that case, you may want to issue a formal complaint and address it to TK max head office. In the letter advise them of what happened like in your original post and make it clear that you deny the allegations the Security officer made. Pointing out you only admitted to it under duress and explain why you admitted it, despite at first denying it.

At the same time, sent a Subject Access Request for all data they hold on you, including documents, cctv footage of yourself committing what you are alleged to have committed.

But before you do that, allow others here to post their advise as well.

Though to be honest as they have banned you, i doubt they will take criminal action, though you will probably receive a letter from Retail Loss Prevention demanding you pay £xx to compensate their client of face legal action (this would be civil courts not criminal courts, so the police will not be involved). Though RLP's chances of winning in court is pretty much zero as they would have to proof you did what they alleged, but also proof that the amount they are asking for is a true representation of the cost TK max incurred as a direct result of what you they have accused you off doing - They'll struggle to prove either if you didn't do it.

teaboy's advice is spot on although I would go one step further and say with certainty that the police will not be involved.

The RLP stuff will look scary but they are toothless tigers!
