  • Warranty on turbo -labour costs

    Hi All,
6 moths ago i purchased a reconditioned turbo for my VW Golf. It was bought online with a credit card and came with 12 month warranty.
yesterday the turbo went bang. This has been confirmed and i contacted the company i bought it off who said they would have it collected and inspected by their warranty dept.
This is fine and i don't anticipate any problems but my concern is that i will have a £300 fitting bill from the garage.
Clearly these are costs i would not have incurred if the turbo hadn't failed.
Is there any chance of me getting these costs back or is it just tough luck?
    thanks in advance
    Tim

Ask the company who sold you the turbo and see if they will pay .

        There are two scenarios here:
        1) what does the warranty say? I suspect it will exclude fitting costs etc.
        2) your consumer rights under SoGA 1979. How long would one reasonably expect a recon turbo to last?
        Somewhat longer than 6 months?
Your position is going to depend on what has caused the problem.
If the company agree it was faulty you might be able to persuade them to help towards the refitting costs. IMO if the turbo was faulty they should pay all costs involved, but whether it is worth suing for them is another question!

Credit card claim for cost of turbo probably possible, but won't cover installation costs.

          Thanks people
i'll be speaking to them tomorrow so hopefully will be in a position to negotiate. The garage have confirmed faulty turbo so it's whether the supplier will pay up some costs!
I'll be back on tomorrow :tinysmile_twink_t2:

Depending on the outcome of the warranty inspection, you may be able to make a claim against the garage for the cost of fitting. i.e if the turbo failed due to incorrect fitting/not following fitting recommendations such as oil & filter change at the same time etc.

You need to see what the warranty report comes back with 1st

Re: Warranty on turbo -labour costs

Ok the turbo company have inspected the turbo.
They have said that it failed due to lack of oil. I have spoken to the garage and they have said this is not likely. There are no blocked pipes and oil pressure is ok.
I wont get anywhere trying to play one off against the other. the turbo company have said they can send me the turbo back so I can get an independent inspection done which they will abide by and refund the cost of if it finds their turbo at fault.
I'll still be left with fitting costs which it says is specifically excluded from the warranty.
So if we disregard everything else...........if the turbo failure is their fault do I have any recourse in relation to my additional costs under SGA or anything else?
              thanks in advance

Re: Warranty on turbo -labour costs

If you can prove a particular party is liable for the turbo failure under SoGA, that party is also responsible for your consequential losses.
This would include the cost of fitting. (Section 48B Repair or Replacement )2) (b)of SoGA 1979)

Thanks Des8 thats a great starting point.
Is there a template letter somewhere on the forum?
                  Thanks again

Re: Warranty on turbo -labour costs

Well your first step is to ascertain exactly why the turbo died.
Was it or was it not due to lack of oil?
If yes, why and whose fault if anyone's?
If not due to lack of oil. why?
And again whose fault if anyone's?
Until you know why, and to whom blame (if any) attaches, you have no one to proceed against.
