    Hopefully this is the appropriate forum, sorry if not.


    I'm having an issue with a company, the company with whom I would've thought I was contracting with is claiming that they are merey third party agents and the contracting parties are two or more customers.

    My question is, can a contract be formed if no party knows who the other party is? There is no means of identifying (without court order to 3rd party agent)?

    Any pointers would be great.

    Is the first company acting as an " introducer" in regard to the other companies?

      I'm not sure?

      It's a betting exchange. So the website allows buyers and sellers to see the odds of an event. the website takes money from one customer account and gives to another to settle the bets.

      So IMO it goes.
      Customer A makes contract with Company. Lose £1 to company
      Customer B makes contract with Comapny. Wins £1 from company.

      The company takes a commission on each transaction. A transaction doesn't take place unless two customers are matched.

      As surely you need to know who the other customer is in order to make a contract, without knowing their is no way of compelling peformance, or raising dispute over fraud etc.

          Terms say they are 'facilitators'. It seems a bit of a meanginless term, no? The terms also have a lovely no liability for anything clause..

              I'm at work so can't visit the site. It's Betfair, so terms and the standard ones on the site.

              My original issue is about a fraudulent bet being made. If the company is a contracting party they should void the contract and put all parties back into their original positions?
