  • Confusing Question about Subject Access Request and sole traders.

    Hi, I'm really hoping someone here can help.

    I am a sole trader, I work with children. I work alongside another sole trader. We both used an online subscription service as part of our duties in caring with children. With parents permission we input data and pictures etc about the children in our care into this subscription service. We also gave them our own data such as bookeeping records, reflective reports, training certificates etc.

    We decided to stop using the subscription service and as we pay monthly in advance we figured we had a month to remove out data form the system. However the provider cancelled access immediately and without warning and we lost a lot of data. Igniring the breach of contract issues, we assumed we could retrieve this data by making a subject access request but the company are saying they hold no data on us.

    Does this mean they have deleted our data or does this mean they wont release this data as some if it is is not about us personally even though we entered the data ourselves and did so in accordance with our job roles, so we assumed it was "our" data?

    Any help would be great. Thanks.

    Generally SARs only cover the personal information of the individual making the request.

    Their are some exceptions but I doubt they would apply to your situation.
