    Really getting angry now.
    Mr Dismissive had told me, yesterday, "If you're not happy bring it back"
    Did and was in conversation with the other person when he came in.
    Again very rude, "what's up with this one" etc..
    Say they still have to send it back and wanted to know what was wrong
    Listed niggles including unknown screen shot but since I had deleted this not sure if he believed me.
    Reading through the consumer rights again it seems I can insist that the shop rectify this
    I would name names but do not want to do this yet.
    Seems to be trading standards come Monday:target:

      You've given them more than enough chance to remedy it, as you say get in touch with TS on Monday see what they say.

          I had a call before I left home from the owner they have checked the device out but can find no problems, infered it was the way I used it, would not listen to me when I told him I had use of another tablet with no such problems.
          He became argumentstive saying they had " paid" for this replacement even thogh they were not obliged to do so.
          Realy angry but intend to contact Trading Standards on Monday.

              I managed to get in today.
              ( after actually phoning Consumer Direct.)
              Was told I can ask for either an alternative replacement and or a refund.
              They also said that charge back could still apply for 120 days from when I discovered the fault.
              However the bank help line denyed this.
              Back to the shop, took Mr DT with me, got a bit of a third degree and Mr Dismissive did not seem to be aware of the sale of goods act, in the small print on the T and Cs it states that my stautory rights are not affected.
              They also semed to imply that I did not use the device properly, charging as and when ( only did it once on the replacement) and that he and aother member of staff had used it " all day" with no problems.
              Mr DT has used both nicads and lithium batterys for Camcorders, model planes and boats, Mr D seemed not to know but the other person did.
              Quite proud of myself for standing my ground and demanding an alternative replacement or a refund.
              Will need to contact TS again to see if what the bank says is true.

                Jut a mention but Amazon can put as many disclaimers on its website as it wishes but most if not all are meaningless They CANNOT opt out of their legal obligations namely The Sale of Goods Act which includes computers/software etc. In fact such disclaimers are unlawful & TS could prosecute them for misleading consumers

                    Its a bit like the notices you see in supermarket car parks "No liability can be accepted howsoever caused" Absolute rubbish particularly if the incident causing damage or injury is the fault of that supermarkets employee(s)

                          Glad to have started a debate!
                          Dont think they were happy I had contacted TS,!
                          The other concern was and is that the origanal importer has been placed in administrtion so agsin it is unclear where any replacement is coming from.

                            Doesn't have to be the same make and model. A replacement should be of at least the same specification. I told you it was a good idea to hit them with TS :tinysmile_twink_t2:

                              Hello all, well owner "not available" until Friday(?)
                              Did some more digging re charge back and goggled it (want did we do without it ?!)

                                Call today, they have alternatives for me.
                                Either a " refurbished" one.
                                ( he actually admitted that my original was not the only one that had been returned with faults and this replacement has been put together from these)
                                I seemed to know more than he did regarding what has happened to the supplier.
                                Or a full refund, guess which I am going for! :cancan:
