  • Apple computer sales of goods act 1979

    Hi can someone advice me,
    I have both a mac book pro custom made, in 2009 October 2.200 sterling.
    This machine had few problems, over heating, all the time, i never thought
    was hardware issue.

    In may 2014 the power supply fail Apple replace it, in June 2014 fail to power up for a week, then eventually start up again.
    In September 2014 again fail to power up and this time for good, the repair centre said it is the logic board.

    I have made several calls to Apple and because i was abroad i lost work too.

    They offered to repair it but i don't like the idea because i lost hope on this models after discovering plenty of other users
    had this bad experince, i asked to replace the machine with same range and cost but they said no for now because machine din't have enough
    trouble.

    I like to take the sales of goods act 1979 to the local county court, rejecting it for not being fit.
    Can someone advice me please?

    You can't request a replacement.

    1. the retailer has the right to repair.
    2. you have had 5 years of benifit of use, so at very best if you took them to court you might win and you might be awarded 10%-15% of the origional value,

    To be honest I think that apple have made a very good offer for a 5 year old PC.

      I agree with ssparks, you would have to provide evidence in the form of an independant engineers report that the computer had an inherent fault from the outset for the Sale of Goods Act to come to your aid.

      The cost of that, although recoverable in the event that you are successful, and the likely hassle of court proceedings would make it not worth your while for a 5 year old mac - albeit I am a mac user and know they tend to have a longer lifespan than PCs.

        What would the Claimr be for they have offered a repair and its 5 years old? if a guarantee under the sale of goods act was for 5 years I thing may companies would be out of business

          Thank you for all answers,
          however,
          I think 5 years is not enough of use, this configuration was custom made and suit it's use till now, and was 2.200 £,
          Apple computers does not reflect the quality that promise,
          since 2007 i had Macpro iphone ipad they all had a fault, i had to pay for it to repair it,
          being a faithful mac user since 1994 i can see since 2005 have no longer quality.
          i still have a 14 years old mac and still works fine.
          I am sure a supplier have to have an idea of the life span of their products.
          Example a car, fridge, tv etc etc.... surely they last more then 5 years.

            A computer is neither a car nor a fridge.

            You are, of course, entitled to your opinion and I share your view of the generally high quality of macs and I am of the view that they are better designed and engineered than lots of PCs. I have an iPhone, iPod, iPad, MacBook Air and 27" iMac which is itself 3 years old and in perfect working order.

            They do, however, use the same internal components of PCs and whilst I believe that they function so well because of a combination of design and integration and management of the components I may be thinking balls.

            I take it by what you mean as custom made is that you ordered it online with a number of modifications to the spec to suit your needs.

            The fact remains, my apple friend, that you would have to demonstrate to a court that it was inherently faulty from the outset if you were to persuade the court that you were entitled to any remedy. That would involve an engineers report initially at least at your cost.

            You need to move on and realise that your faithful pal is dead.

            Saying that, they have offered to repair it, have their hands off - I bet you could google for hours to find an Acer, Lenten or whatever customer that has had that offer.

                Sure Acer cost few hundred, maybe next time i would be better of Acer, i disagree 5 years is not long enough, all component are made in China is true, the new retina MBP are sealed so no repairable, consumers should complaint and stop Apple making machine like that their strategy is for consumers to bay the apple care, and so the law should change and protect buyers in the end of the day if Apple have made millions we gave the money for sure they wont have no more money from me, BTW i did take apple to small claims over a 3 years multimedia monitor and i won. Is this forum run by David cameron?
