    Hi I'm hoping someone can help. We had booked to go to NY next month with a company bright sky's travel but received an email yester from the administrator as its gone into liquidation. We paid the deposit on credit card so I was wondering if we have a valid section 75 claim. I know booking through third parties when the end supplier fails aren't usually covered. However as we were getting both flights and accommodation through the company does that make it a package and therefore our supplier has failed?

    As far as I know the third party exemption means, for example, if you paid by credit card via a third party payment system such as Paypal.

      Thanks for that. So would that mean this wouldn't be classed as third party? We have been advised as well to file a fraud claim on the action fraud site but I'm not sure if we can do this at same time as the 75 claim

        What I'm saying is that for the purposes of a section 75 claim a 'third party' refers to the payment system and not the supplier.

        I'm not sure your circumstances involve fraud but if they do and you report the matter to Action Fraud (they don't handle claims as such) I can't see that it would conflict with your sec 75 claim.

          Wee they uk registered? Then as you have booked and Accommodation you may be comered under the travel insurance scheme ATOL? ATOS?
