  • Mobile Phone Purchase, Distance Selling Regulations

    Good evening,

    I am quite keen on ordering a new phone from Very.co.uk.
    I have found a good price on this site and the phone comes sim free. I have never ordered a smart phone like this before, so I am not completely sure if it will be the one for me.

    I noticed on the page for the device, the following:
    Code:
    Non returnable under our Approval Guarantee, once installed or connected. Your statutory rights are not affected. See Returns section in our Help pages for more information.
    Would I not be allowed to send the phone back (within a reasonable time) and packaged as I received it, if I deemed it not to be right for me?
    I don't plan on making calls from it or installing applications, but I would like to leave it on and see how long the battery would last etc before deciding if it is the model for me.

    Any advice would be great.

    There is an exemptin to the distance selling regs returns / cancellation requirements in regard to computer requirement , which many apply to I phones etc. so I think that it would not be applicable in this case. I would be very surprised however if you could not return the item as long as it was repacked and looked like it was in the original condition.

    However i would recommend an examination of the specification would tell you all you need to know about the phone prior to ordering it, and perhaps if you wanted to see what one looked like a trip to one of the phone shop would fit the bill, just to be on the safe side.

      You could also ask the vendor for the extra info if it is not already in the specs.
      With items like this you will often find more info by googling for reviews.

        Thank you very much for your posts. I have taken a few trips to mobile phone shops, but it is quite difficult as the handsets are always encased in security locks which makes it very hard to:
        1. Get a proper grasp of the device
        2. Get a good idea of the weight of the device


        I will drop the company an email and see if I can ascertain any additional information. Maybe I am a bit of a fuss pot, but would really kick myself if I ended up getting the wrong one.

            There is no problem with handling the phone and returning it of course, the problems start when you turn it on.

              I think the problem is that some of the companies ask that you don't break the security seal around the outside of the box. This makes it impossible to get the device out to give it a hold and pretend to make a call or press the buttons to see how it works in your hand.

                I don't think this would be a problem for mail order. You have to be able to insect if the device is damaged i would have thought.
