  • Who do I sue?

    Hi to all. Some advice much appreciated.
    I purchased a dishwasher from Appliances Direct.

    Appliances Direct
    took the money from my Debit Card.
    I paid extra for a GUARANTEED next day delivery. This was confirmed by them by email. Later the same day I received a second email confirming the actual timeslot. Based on this I took a days leave and as I have used up my annual leave, I had to take it unpaid. On the following morning I received a 3rd email confirming that it was going to be delivered that day. Within 15mins I received a phone call saying it was now not going to be delivered. In essence I had lost a days pay (just under £130 after tax) I rescheduled the delivery for the following day (taking a second unpaid day off) It was delivered this time.

    I contacted Appliances Direct who told me that if I could prove my losses, they would reimburse me. I got my employers to confirm in writing the exact amount of my loss and submitted it.

    Appliances Direct then refused offering only £40 less than a third of my actual loss. They refused to budge so I issued a County Court Claim.
    I received their Defence paperwork and in essence are saying that as Appliances Direct are only a Trading Name and not the Parent Company, (Buy it Direct Ltd), My claim is invalid!

    Can this be right????

    Jaguar's parent company is Ford but if I had a faulty Jaguar, I would sue them not Ford Surely??

    In any event I bought the Machine from Appliances Direct and Paid them too

    Any advice would be most welcome as also an opinion as to the chances of my successfully suing them.

    BEWARE!! In Appliances Direct / Buy it Direct World, the word GUARANTEED does not mean what it means elsewhere.

    You need the name and address of the registered office.

      Thank you for your reply.

      I did send the paperwork to the registered offices and they did receive it.
      I believe they are just being "cute" trying to wriggle out of it. How can that be their defence?

      Di I have to re-issue the paperwork or does the Court apply an amount of common sense?

          Appliances Direct Ltd exist as a separate company register number: 06527186 (http://wck2.companieshouse.gov.uk//c...239841&#result)

          If a limited company is part of a group of companies, you need to sue the actual company, not the group. In the overwhelming majority of circumstances, the group will not be liable for the debt.

          Their defence fails.

            I dont think this is the right company Des


            Appliances Direct are the specialist appliance division of the BuyItDirect Group

            They are not a Limited Companyy but a trading name so imo you would sue Buy it Direct trading as Appliances Direct

                Surely if you have the original paperwork then it should state the name of the parent company t/a Appliances Direct and a company number to further define it. This should solve the matter.
