      The burden of proof that a claim is covered by an insured peril is on the policy holder.
      The fact that an insurer's first reaction is to repudiate the claim could be down to the insured framing the claim poorly, and/or the claims handler being a spotty faced erk who has no comprehension of insurance, and finds it difficult to complete a tick box.

      Let us have sight of the policy.

      Insurers will offer this sort of settlement as it is the cheapest option for them.
      Also if insurers failed to meet third party claims like this one, MIB costs across the industry would soar and there would once again be calls from outside the industry for compulsory 3rd party insurance to be nationalised.
      The ins. industry do not want that, and seeing the mess government agencies make nor do I.

        It could have been an exhibition arranged by her employer and at which she was working, i.e. travelling to a different place of work

            Sorry, I was dealing with the facts as they have been presented. I could say "there, there, there, it will be alright" but the simple fact is if the insurance company wishes to stick its heels in the OP's wife was in breech of the policy and no amount of sympathy will change that. The cost of buisness insurance vs SDP&C is minimial £5-10 but people skimp on it and then have to come on forums looking for help and sympathy; how harsh would the police have been if they had attended the crash and found out that the driver was uninsured? (I was gonig to say technically uninsured, but since it is clear in the policy there is no technically about it)

              Well I just thought that without establishing facts, and it is very distressing, especially for a woman involved in a motoring accident. You could have toned your comments down a tag...

              This makes interesting reading........
              It's from H.M Revenue and Customs...
              It defines what it considers to be work related use of a car, and non work related use of a car...

              WORK JOURNEYS:
              Journey that you have to make in the course of doing your job.
              Examples include; Delivering good, or making calls to customers.

              NON WORK JOURNEYS:

              Private Journeys unrelated to your work.
              Journeys to and from your place of work (commuting journeys), even if you call at a clients on the way, (unless the journey is significantly different from your usual commuting journey.

              It may be helpful if JC contacts HMC to find out if they would consider the journey to an event, as business class use.
              If they don't, then JC's wife could have a case for an appeal to her insurers.

                It is not yet clear how the policy is written.
                We have not seen the policy wording and only have the OP's report of what was PROBABLY a phonecall with someone in a claims centre who has interpreted a legal document.
                Quite possibly that was a correct reading of the policy, but often those claims centre workers, working from a proforma sheet are not aware of the subtle differences in policy wordings.

                As requested previously could OP please supply a copy of policy & proposal forms, and full details of the incident.
