  • Slander Correct steps

    What are the correct steps for bringing a slander case against an organistion,
    Slander is a high court case and requires specific steps thanks.

      I think you will find it difficult to pursue a claim for defamation by slander against
      an organisation, as slander is defamation in a non permanent form, generally the spoken word.
      In slander cases, you will also need to prove that you have suffered financial loss, unless the allegations relate to your profession or an offence punishable by imprisonment

        The best advice is not to, notoriously difficult to prove and even more-so to demonstrate quantifiable damages, generally the only people who benefit are the solicitors. IMO

          I am wondering if it is harassment rather than slander. Could the OP provide us with a rundown of what has happened, please?

            Given that an organisation is involved (Left Hand, Right Hand), a SAR might provide a suitable document.

              Firstly I am going to do it myself, and if it causes cost to the other side all the better. I have to make sure that this type of thing does not happen again.

                    Was the untruth in spoken or written form? Have you served a Cease and Desist letter on them and/or been granted an injunction to prevent repetition?

                      It was in spoken form I have not written the Cease and desist letter. Could you give me a link to a Cease and desist letter format. thanks. or the elements that must be included. Spoken form is slander, written form is libel. Thats my understanding.

                        You are correct in your analysis as to the difference between slander and libel. As alluded above, slander is notoriously difficult to prove and litigate. It would help us to help you and provide you with the best advice we can by answering the following -

                        1. What is the exact nature of the slander?
                        2. How many times has the slander been uttered?
                        3. Are the same persons involved on each occasion?
                        4. What effect is this having on you?
                        5. Have you suffered any financial or other loss as a result?

                            Have you looked into whether you're likely to be granted a right of audience to conduct your case in the High Court?
