  • Halfords - Faulty Water Pump - Small Claims Court?

    Here is a brief background to problems I am currently having with Halfords, regarding a faulty water pump.

    The water pump was fitted in Aug 2011, along with a cam belt change. This came with a 12,000 mile, 12 month warranty.

    Last month the water pump failed, so yes over the 12 month warranty by 9 months and the mileage was around 16,000 since the change.

    The first signs of a problem with my car was water leaking from the front of the car. I didn't know what it was, I didn't suspect the water pump as it is relatively new, this part is changed when the cam belt is changed only to save on labour, the cam belt has a life of 60k miles, for the water pump that is an absolute minimum, but it is not a part that should fail, so I had no reason to take it back to Halfords.

    So, I took it to an independent garage, who advised a faulty water pump and that it was not advisable to drive the car in this condition and that it would need to be changed.

    I had the work done, but the garage made the point of telling me, that the part should not have gone so soon, it was either badly fitted in the first place or a poor quality part.

    This then led me to contact Halfords about seeking some sort of refund for the faulty parts.

    Halfords have out right refused to acknowledge my problem and have said, it is out of warranty, not their problem. I have explained to them the SOGA, but they just plainly ignore it and stand by their decision.

    I have made all parts available to them for inspection, which they are not interested in.

    They make a point of saying that I should have gone back to them in the first instance, when I had problems with my car. But as I didn't know what the problem was with the car, I couldn't take it back to them to complain about a part I didn't know was faulty.

    This is a brief version of events. I am now at a point where I have sent them a letter before action.

    Does anybody have any advice on the small claims court, and the likely hood of my claim being successful or not?

    If you are going to carry on with the action you have warned about in your letter then think it would be advisable to get written proof of what was said at the garage, an independent opinion is always helpful and sometimes required.
    You have obviously read SOGA and know your rights.
    Maybe an idea to have a web search too see if this is a problem that happens regularly as it could prove to be an inherent fault which would further help your claim
    What is an inherent fault?
    • A fault present at the time of purchase. Examples are:
    • an error in design so that a product is manufactured incorrectly
    • an error in manufacturing where a faulty component was inserted. The "fault" may not become apparent immediately but it was there at the time of sale and so the product was not of satisfactory standard.

      Would the garage that did the work to rectify the problem, still be classed as independent? I could get a report from them easily enough, as it was them who showed me the parts and told me the problems and that it should not have happened so soon.

      There are many stories about Halfords Garages all over the internet, poor standard of work, poor customer service etc.

      It is just a bit daunting as I have never used the small claims court before.

        So, I have started the small claims court process. It was issued yesterday.

        I am a bit worried I may have been to brief in the particulars section, as it was limited to so many words, when filing online.

        I am just waiting to see what happens next....
