    hi!

    i need your help!
    i purchased a pair of expensive dr martens last week and they were in the sale. i was told they can only be returned or exchanged if there was a fault....now as i say dr martens arent cheap and after wearing 4 times(which in my eyes isnt good enough for the price) the insoles have come away a little at the back. is this classed as a fault or will i be told this is a fault of my own?

    Whence did you get them?

    Could they have been counterfeit?

      Goods must be of reasonable quality and fit for the purpose for which they are sold. A manufacturing defect would entitle you to a refund. They cannot force you to accept an exchange or credit note.

      Are you sure that this is not a sign of initial wear?

        i got them from a store that have sold dr martens for many years and mainly only sell dr martens. ive worn them 4 times. surely this means they are not fit for purpose. initial wear (ive worn them 4 times) shouldnt mean that the insoles come away.
        where do i stand as surely this means its a fault

            i havent been back as yet as im at work until friday. i just wanted to gather some advice. i class it as a fault, they are expensive shoes so the insoles shouldnt go after such little wear. i agree it is a fault but feared i would have a battle at the shop

              hi Sam

              Your case is a clear one the goods breach s14 of the Sale of Goods Act and what you want is your money back. Do not accept a credit note.

              The only time the Sale of Goods Act would not apply is if you had done something to damage them or have misused the goods. This is clearly not the case with you.
