  • Booking a hotel online. , they lost My booking , what are My rights?

    Hello everyone, i booked a hotel thru big British travel site , booked in november and paid in full in december. Ive got confirmation and hotelvouchers send to me thru email.

    now When we arrived to hotel in jamaica on the 11th , the hotel doesnt have the reservation and the hotel is fully booked from the 14th and forward . I called the travelsite for Three days now and there saying there gonna get me. An other hotel, But im not so sure, the hotel we booked is all-inclusive with kids club and beachfront. The travelsite says that the hotelprovider is the one WHO screwed up. What are My rights to decline their offer for a new hotel if it dosent meet up to the standars that the orignally booking had.

    which travel site was it, as it maybe your contract was with them or it may be that your contract was with the hotel, so it depends what is in the terms and conditions.

    By the sounds of it, you entered a contract with the travel site to book the hotel, therefore they failed to provide the service you had paid for and are liable to fully refund you, and compensate you for any losses you incurred as a result. Or provide you with alternative accommodation matching what you had originally paid for, or alternative accommodation as near too, but refunding you in part for anything that is not included in the new accommodation that you had paid for in the original booking.

    But as i said, that depends if your contract was with the travel site or the hotel itself, either way, on of them is liable to refund you etc.

    As per the travel site saying the hotel messed up. Well if your contract is with the travel site, then any failings by the hotel, in a contractual sense is between the travel site and the hotel, as they will have a separate contract between themselves. Hence why the Hotel is on the travel site in the first place.

          My contract is with travelrepublic, they have sent confirmation to me that the hotel is booked and paid for , thou the hotel has no. booking , so its travelrepublic fault.

          so what should i do?

            You need to write to them with a formal letter before action, informing them they are in breach of contract and regardless of their argument about it being the hotels fault, such argument is not relevant to you as your contract was with them not the the hotel. Therefore they need to take the matter up with the hotel separately. Therefore if they do not refund you the fee you paid them for the booking in full, along with compensating you for additional loss (cost of finding alternative accommodation etc) caused to you to a sum of £xxxx as a direct result of their breach of contract (Failed to provide service that you had paid for).

            It may take a while to get get this resolved but you will eventually. They also have a duty to find you alternative accommodation too, or at least pay for it.
