of harassment, violence and threats of violence this was in 2011.The housing trust did not do a thing with this tenant the harassment kept on so we had to get a solicitor to take him to court again in 2012 he was again found guilty and we got a life time injunction .and at the moment we are making progress to go to court again in all this time the housing trust say they have not sufficient evidence to do any thing with there tenant this is having a big affect on our health I have a heart condition I was just wanting some feed back on what we can do next as we can not pay any more for solicitors we have over 300 pagers of evidence and witness statements and also a police statement .I have got all paper work I can send if it would help .

Was the injunction granted under the ambit of Section 3, Protection from Harassment Act 1998, and what were the conditions the court attached to the injunction?

      Hi
The injunction was pursuant to section 3 of the protection from harassment act 1997.The court ordered that the defendant and his son are forbidden from intimidating, harassing ,provoking, pestering using or threatening to use violence, assaulting or threatening to assault the claimants or visitors to their property or encouraging their servants or agents to do the same. thanks for taking the time to answer .

          Guilty verdict.

The housing trust did not do a thing with this tenant [....] the housing trust say they have not sufficient evidence to do any thing with there tenant ...
It's an unpopular truth for some, but it's so nonetheless - Housing staff are frequently extreme Left-wing types - pro-drugs and sympathetic to criminals.

I am aware of a recent case in which a cannabis farm was discovered in a council property. The ALMO obstructed the police and finally tipped off the offender. That's the sort of people that you are dealing with. You can expect nothing from them.

... the harassment kept on so we had to get a solicitor to take him to court again in 2012 he was again found guilty and we got a life time injunction.
Second guilty verdict. Lifetime injunction which he has now breached.

... we have over 300 pagers of evidence and witness statements and also a police statement.
You appear to have more than enough evidence. It would also be worth getting hold of a copy of the tenancy agreement. Go through it, highlighting where and how many times the tenant has breached it.

If you feel confident enough, you could present this case yourself. If you don't, then it would be worth biting the bullet and paying for a solicitor. You are now looking to get him sent to prison. It's the final push, so grit your teeth and drive the knife home.

It would also be worth involving your MP. Send him/her a concise, clear account. Make it clear that the HA is being systematically obstructive. Are you or your wife considered disabled in any way? If so, make sure to include that fact.

Thank you for alluding that information. Under Section 3, Protection from Harassment Act 1997, a defendant who breaches an injunction granted under this provision shall, on conviction, be liable to -

            a. a fine not exceeding £20,000 or a term of imprisonment not exceeding six months or both (summary conviction); or
            b. a unlimited fine or a term of imprisonment not exceeding five years or both (conviction on indictment).

Because the provision carries a term of imprisonment not exceeding five years, it falls under the heading of an Indictable Offence. If your local police have a copy of the injunction, if they can be arsed, they should attend and arrest this neighbour from hell and take him and his son to the local lock-up.
