How do I go about obtaining an ASBO against neighbours who have tv on too loud at night and several barking dogs in the back garden. I contacted Environmental Health who sent around a sound recorder but informed the neighbour that this was being done!!! Said it was a legal requirement which totally defeats the object as they kept the dogs indoors whilst the recorder was in operation now its gone, and we are back to square one. I also suspect a retaliation as the noise levels have increased.

Are these bods from the local Environmental Health Department for real? I'd be inclined to see if you can speak to the Chief EHO about this. I have never heard of any provision that requires EHOs to tell someone who is suspected of breaching noise abatement laws that they are being monitored. As for ASBOs, it is my understanding that these have to be applied for by the police/local authority.

OK I will chase this, needless to say the week I had the monitoring equipment was like Heaven on holiday.

ABSOs have to be obtained through your local authority, and only with strong undeniable evidence to prove or overwhelmingly suggest anti-social behaviour is an ASBO granted. Loud music or noise disruption is a difficult one to prove, but, there is nothing stopping you making your own video recording of said incidents and providing this to the EHD...
