    Hi,

    First post on here, I know there has been similar threads on here, but none quite similar to mine, so any help is greatly appreciated.

    On Friday night I went to a bar in the city of London and was told on entering it was their 'policy' that I had to check my bag into their cloak room, which I did. There was no charge for this but I was given a numbered ticket. I saw the tag being sellotaped onto my bag and it was taken into the back.

    When I came to collect my bag later they told me they didn't have it, and I would have to wait until everyone had left, Which I did. Once everyone had left again I was told they didn't have it, and they must have given to someone by mistake. I was given the managers card and told to contact them the next day. They pointed to their sign saying they do not accept responsibility for property, I pointed out another sign that said it was their policy to put my bag in there in the first place, and they have a duty of care. I noticed a distinct change of attitude in the manager.

    With no other option I had to leave and since then I only managed to get hold of someone on Monday (they were closed all weekend), even then I only got hold of the manager after I went in there in person. I had already emailed them on Sunday saying they were hard to get hold of, and if they have had my bag handed back in. On Monday they said it had not. Today they also said that it had not. The new manager I was speaking to earlier this afternoon mentioned compensation, but I spoke to him this evening he didn't mention it.

    I have now followed up with an email saying that I think its fair I receive compensation so I can replace the laptop and the bag, as it was the bar's negligence that they have handed it to someone else who it didn't belong to.

    Basically what Im asking is, am I legally right here? Surely they have been negligent, they can just put a sign up saying no responsibility when I was told I had to put my bag in the cloakroom in the first place?!

    Again, any help is greatly appreciated.

    It may be a daft question, but is the area covered by CCTV?

      Yes, the guy I spoke to on Tuesday said he has reviewed it and has seen me hand the bag in, but can't see anyone taking it out, as it's a black and white camera.

      I then asked if they had actually checked the room properly, he said they had.

          What does the spectrum recorded have to do with it?

          If nobody was observed being given the bag "by mistake", then one might suppose it had been stolen by a member of staff.

          Is it insured?

          If not...

          Send the bar a letter by Recorded Delivery (or Special Delivery) giving them fourteen (14) days from their receipt of the letter to return the bag and its contents which had been entrusted to their care or, failing which, to pay you £ nnnn, being the replacement cost of the bag and its contents. Tell them that, if they do neither, after the 14 days have elapsed you will commence court proceedings without any further notice.

            Hi Ryanthomas,& welcome to Legal Beagles.

            Similar situations have been posted before.

            The replies are generally the same; the club, bar, pub or whatever, on receiving the item(s), proceed to owe a duty of care for the safe storage & return of the item(s).
            Certainly, if it were me, & the item(s) were of reasonable value, I would SAR the bar for the CCTV footage before they manage to 'lose' that as well! (labman was hinting at this in post #2)

              Disclaimer notices are subject to the terms and provisions of the Unfair Contract Terms Act 1977 (as amended). This means that any disclaimer notice must be reasonable in the circumstances. As the others have said, the bar took possession of your laptop bag and, as such, had a duty to take reasonable care of it whilst in their possession. You will need to replace it on a like-for-like basis and the bar will need to pay how much it costs you to replace it, not what they think they should pay.

                Oh......I give you all permission to slap me hard but is there actually any proof there was a laptop in there? Does OP have to prove it was in there?

                      I suppose the bag might have contained a panel of wood or lumps of brick to the approximate weight of a laptop computer, but a bogus claim for loss would only work if the owner of the bag could be certain it would be lost.

                      But, on the balance of probability, is that at all likely?

                        Aaaah Cloggy..you have not seen the episode of 'Road Wars' filmed in Reading where 'laptops' were sold but the bag contained bottles of water.............and yes,,some folks fell for it lol

                          I imagine the way in which it is handed over in the CCTV footage will make this clear. I would hand over a laptop case with a laptop in it very differently to how I would an empty case. It also begs the question, why would one carry around an empty laptop case (I know there's answers, but .......)

                            Your experience may differ, of course, but I have never known a laptop to make a sloshing sound when shaken.

                              Was just a fleeting thought as to what the club may maintain..and yes,I would hand my laptop bag over carefully.
