In early July this year, I booked a 3 night stay, B&B at a Scottish Hotel, They quoted £324 for two persons inclusive. I accepted, gave my credit card details to secure the boking and received email confirmation. Today, I received an email from the hotel, stating my booking had 'Slipped through the net' before they had put together their 'Ryder Cup Package', which consists of a 4 night stay, B&B plus two evening meals, at a cost of £312 each! I phoned them to discuss and was told that I could either upgrade or cancel, no other alternative! Is this covered by Breach of Contract?

I will bump this for one of our members who is more familiar with Scottish Law than I am, but I have a feeling the hotel is on a sticky wicket. Saying you can upgrade is extracting the urine, unless they offer to do so at their expense. The only other alternative I can think of is that you and they agree a mutually-agreeable alternative date and they upgrade the room or boarding arrangements, i.e. bed and breakfast upgraded to half board, at their expense as compensation for the inconvenience they have put you to as a result of their blundering.

Under English Law this would be breach of contract. They could argue that it was void due to mistake (they should not have taken the booking because they were in the process of putting a different deal in place for that period), although given the time elapsed between taking the booking and cancelling it, this would be difficult to sustain.
If you have suffered no loss, your best option is probably to cancel and walk away ... and then give them an unfavourable review on TripAdvisor.
