  • Sorry nothing new from me...again Tesco

    Hi Everyone.
    I'm new to this forum and I hope I will get some advice.
    I had a bad experience to buying alcohol at Tesco last Thursday (7.03.13). I'm 39! and I was with my friend who is 33.He went to buy a 4 bottles of beer and the checkout counter refused to sell the beer to him because she decided he wasn't look on his age.Unfortunately he doesn't have an ID.How the lady counter making decision who can buy or not,I understand the policy/law not selling the alcohol who is under 25,but he is 33 and don't need to walking with the ID at all time?
    Then, I went to buy the same bottle of beers.I went to another till and that lady want to sell the beer without problem ,then the checkout manager came and she refused selling the beer to me ,because I was with the other (mean my friend). I showed her my ID but she doesn't want to check even my age.
    I know the Tesco Customer service is working in poor order so I won't make any try to resolved my problem there, but could you advice what should I do next time?It is legal to ask me or somebody else about the age?Why one person make decision to sell or not to sell alcohol?

    I am afraid they do have the right to refuse you alcohol if they believe you are underage. If your friend did not take any ID with him then that is unfortunate but I would add that it is an offence to sell alcohol to someone if you believe that they are buying it for someone under age. Did he not have any identification at all with him?(not even a credit card....you have to be 18 to have one of them)

      Hi and welcome to Legal Beagles.

      The major supermarkets tend to take their legal advice on matters such as alcohol and DVD sales from commercial lawyers who, quite frankly, know next to sweet FA about the applicable legislation. Liquor Licensing legislation can be muddled at the best of times. Strictly speaking, any person or company holding a licence to sell alcoholic beverages for consumption off the premises (Off Licence) can refuse to sell alcohol to anyone. As for asking someone for proof of age, this is perfectly legal and they are within their rights to request proof of age.

              My son is 25 next week and always takes his ID when he's going into town for a drink,or buying booze from shops...it's the shops perogative to insist on seeing ID and their right to refuse the sale if they are not given it.
              Personally,,I can't see the problem with it. (oh to be asked for ID.....those were the days lol)

                  They are perfectly in there rights to refuse you as if they believe your friend is underage and couldn't buy provide photographic evidence to confirm his age and then you tried to buy the alcohol if they think you may be buying it for someone they believe to be underage then they have to refuse you service otherwise they would be breaking the law I used to work in a supermarket as a supervisor on the checkouts and that is the law I'm afraid

                    Just think yourself lucky that, with your accent, they didn't refuse to sell you any potatoes.
