I purchased a used boot lid for my car mail order from a company specialising in used car parts called dronsfields
The item was silver to match my car and had a rear heated windscreen as I needed.
I agreed a price of £138 inc delivery which I then negotiated to £118 after some damage to the paint was shown to me in a photo.
The boot lid arrived with the glass smashed.
I have sought replacement glass the cheapest price is £205.
I have sought a replacement part of the same colour complete with the glass but cannot find one.
Dronsfields have offered a replacement part in the wrong colour which will cost £160-£200 to respray plus they will obiously have the cost of collecting the damaged and delivering the undamaged part.
Under SOGA 1979 s 53 do I have the right to recover the cost of putting right the damaged part?
