  • Advertising and delivery late

    Can anybody give me advise?
I see a advertising of a company which sale kitchen electronic devices such as rice cookers, blenders, etc. That company advertises on the radio that for any product bought during November to January, if the poduct is not delovered on or before the written Delivery Date, they will refund 50% of the purchase price.
So i come and buy a new rice cooker and they delivery late
When I required them refund 50% of product price, they refuse and said that in written contract (i sign a written contract when i buy product) have no anything about refund money if company delivery late.
what should i do? can i win if i sue them?

If they advertised it and it included that particular product, only for it to say something different in the contract, then its misleading advertising and should be reported to the advertising standards authority.

If your contract does say your entitled the 50% discont then yes you can claim.

That sounds like Bait Advertising which the ASA jump on. It may also be a breach of Consumer Protection Law. As well as reporting this to the ASA, as recommended by Teaboy, contact your local Trading Standards Department, too.

My friend said that the oral contract (the advertise) was create before the written contract (I sign the contract when i buy product)
So oral contract will be invalid
              Is that true?
I think that i made oral contract and written contract at the same time (when i buy product)
              Is that true?

                  Re: Advertising and delivery late

Radio advertising is subject to guidelines laid down by OFCOM. It is also subject to all relevant aspects of Consumer Protection Law and the British Code of Advertising Practice. As stated earlier in this thread, this sounds very much like Bait Advertising. If they made an offer in an advertisement, then you should be able to hold them to it. Contact your local Trading Standards as well as the ASA and also speak to OFCOM, as commercial radio stations broadcasting in the UK are licensed by OFCOM and subject to their rules and regulations.
