As always your advice would be welcomed. My young son bought some trainers just under 3 weeks ago and paid £60.00 cash (from his birthday money) to our local JD Sports store. After wearing them around half a dozen times (normal wear no football or anything like that) the front of one of the trainers has split rendering them unwearable. I spoke to the store and they said that company policy is not to exchange or refund anything without a receipt or other proof of purchase ie credit card/bank statement. I only wanted a replacement pair not a refund. I checked out the Sale of Goods Act and this says:
Proving the item was purchased from you
If a customer returns an item and complains, you are entitled to check that the item was bought from you and on the date claimed. It is the customer's responsibility to prove that the item was purchased from you.
A sales receipt is a good way of checking; if the customer has lost their receipt but is able to offer other evidence, for example, a bank or credit card statement, packaging etc, then you must accept this if it demonstrates the goods were purchased from you.
Although sales receipts are not legally required, you should ensure you provide them for customers as a safeguard for both sides, should there be a complaint.'
I spoke to JD's head office customer service and mentioned the SOGA but they told me 'regardless of that our company policy is not to accept returns without a receipt - take it further if you want'!
As cash was paid and my son does not have the receipt 'well the trainers fit so I didn't know I had to keep the receipt' is that it then or is there anything else to be done?
