The Heating system was 90% completed and then the plumber never came back to finish the job, but in May 2011 contact me asking for the balance I told him he needed to come and finish the job and again never saw him.

He has now conatacted me now in Jan 2012 asking again for the balance I was just wondering where I stand legally...
One might suppose that, unless you hired another plumber to finish the job, you stand (or sit) in a rather cold house.

As for his desire to be paid, that may also depend on whether or not the work was completed by someone else. Because he left the work uncompleted and did not fully perform the contract to fit the central heating system, it is hardly reasonable of him to expect to be paid for work he has not done.

If you have paid someone else to finish the work of the disappearing plumber, how much more (or less) than £800 did that work cost?

Just an update, after replying to him that I was waiting for a year and half for him to finish the job, He has not been back in touch so when the better weather is here and I can afford not to have the heating on I am going to employ a different plumber to finish the job.

I am astounded that you have been so remarkably patient.

How much work still needs to be done?

This is most unbelivable but I thinks there is about £200-£300 pounds worth but I think the lack of contact after I stated the job was over a year and a half old might be that there are issues with Gas Safe as the job was not finished and I have been issued with the Gas Safe Certificate.

The only problem is the boiler is now about 2 years old. any way I have made my mind up I am going to employ a plumber in the summer to finish the job service the boiler.

If he comes asking for money I am going to tell him to whistle for the difference I am having that as compensation for having to wait.

It would be better to send the oaf a letter (by Recorded Delivery, so you can prove when he got it) giving him the ultimatum that, unless he contacts you within one week and completes the work within two weeks within the budget agreed, he will have broken the contract with you.

That should safeguard you if the jerk tries to claim any outstanding monies from you.

You should also telephone Consumer Direct, on 0845 4 04 05 06 as it is quite possible that the alleged plumber may have done this with other customers.
