    Does the council enforcment officer have the right to fine a person dropping a cig. butt on private land i.e in outside shopping arcade

        Another point of view:
        The owner of the land adjacent to the shopping mall could make a formal complaint to the council. The council would then have to investigate that complaint.

                In reality, I guess that it must be a problem for people who live or, own land adjacent to a shopping mall car park; careless shoppers may throw rubbish and cigarette buts onto the adjacent properties?

                Perhaps, and this is only a perhaps, that there may well be a written covenant with the council that deals with this very problem?

                Would you like to live next to a shopping mall car park?

                I certainly would not; the mind boggles with the potential problems of noise etc...

                The OP, should read the information on the back of the parking ticket.

                  This is what I posted on the other thread.


                  If you mean a pedestrian area, then probably. Best thing to do is look on the back of the ticket, it specifies what legal powers have been granted to the Council/CEOs. Then Google the relevant parts.It should also say on the front of the ticket which bylaws/act etc you have contravened.

                    Think of it another way........

                    Smoking is bad for your health, costs a fortune, it is selfish and antisocial and not nice for anyone to walk through the smell and have the stench of someone elses addiction on their clothes. The quicker its banned from public areas completely the better, there's nothing worse than walking along the street behind someone puffing away, or even worse going out for say a meal and having to walk through clouds of smoke as you try to dodge the addicts in the doorway.

                    I'd take it as a lesson and give it up.

                    Hey, but thats just my opinion, over to you all, I'm sure I've rattled at least a few of you smokers out there lol.

                      I don't know about on the spot fining by so called enforcement officers anywhere, however in our own area North Wales, the councils' regulatory departments have brought people before the magistrates courts.

                      Including I hasten to add a case whereby the councils dog warden sitting in his van allegedly witnessed the throwing of a cigarette butt inot a raging sea from the promenade.

                      Fortunately the magistrates had a little more common sense than the jobs worths.

                      By the way I am non smoker but would defend the right of those that wish to smoke. Just remember it is often the non smoking heroes that drive badly the most polluting vehicles. just listen and watch around you.

                        Not much on it, post #4 is the most informative, but even then I didn't put the legislation into it so probably not much use. As I said before, I think the relevant legislation is detailed on the back of the "ticket" they give you.
