  • Cashback Offers from Toshiba

Has anyone had any dealings with Toshiba over their recent cashback offer if you bought one of their TV's from certain suppliers? Their T's & C's were that the buyer had 7 days to register the product from the date of order to claim back £100.

I bought a TV from Amazon and it took 2 days to arrive. Unfortunately my father in law was taken into hospital rather unexpectedly and I didn't get on to registering the TV until 8 days after the order. Their online site generated a registration certificate so it was sent off, along with a covering letter explaining why I had been unable to process it promptly.

Toshiba have rejected my claim because I was late registering.

You can guess I'm not too impressed, especially after discovering their cashback promotion for laptops gave buyers 30 days to register their laptop.

Where do I stand with this? Does the fact they issued a certificate of registration outside the 7 days mean they are obliged to cough up? Is the loss of two days waiting for the TV to be delivered ( it couldn't be registered without the serial number) of any significance? I have written to their customer services and I await their reply.

You have answered your own question. You were late registering the TV.

If the terms of the deal were that you must register within 7 days of order and you registered after 8 days, then I am not surprised that Toshiba have rejected your claim. The fact that their site issued a certificate of registration is immaterial, as is the cashback promotion for laptops.

How long ago did you order the TV?

It was ordered on the 10th November and it arrived on the 12th November. I couldn't register the TV until it arrived because the serial number of the TV was required before it could be registered, so that lost me two days.

What were the stated delivery terms?

You cannot have lost two days, unless the delivery terms were that they were going to deliver on the same day. This is very unlikely, so at most you could claim that you "lost" one day.

If you ordered the TV on the basis of the cashback offer, then you really needed to have heeded the terms and complied with them.

I suspect that none of this is particularly helpful for you, but I fail to see where you may have a claim against them.

The reason I asked when you bought the product was because you do have rights under the Distance Selling Regulations and although it would be an abuse of those rights, you may have been able to return the product. However, that avenue is no longer open to you, due to the length of time you have had the TV.

I would have liked to have heeded the terms but my main concern was my father in laws health and his being taken into hospital at very short notice, something which I did explain when I sent in the certificate of registration. Why is the issue of different terms being offered for another product immaterial?

Because you did not buy that product.
