  • RAC shambles - where do I stand legally?

    Broke down 9pm Friday night 100+ miles from home.
    Over the next 25 hours, had lots of promises of attendance, lots of conversations with managers, and eventually they sorted me a tow truck and hire car at 10pm last night.

    I spent 16 hours sitting in my car in a layby (I did briefly uber to my hotel for 5 hrs sleep first night). No AC, no access to water/food, no access to toilet facilites. Also, I'm blue badge holder - to be honest I REALLY struggled. Advised RAC several time got ignored. Home now but its taken its toll on me a lot - Im exhausted.

    I'm guessing they're t+cs allow them to make best efforts? Rather than specify maximum wait but I feel this is absurd. They did endanger my heath IMHO.

    Legally, do I have a case here for anything? (I missed my event which was 8pm saturday too which cost £)

    Formal complaint to RAC ( https://racportal.icasework.com/reso...0153337&db=rac ) Detail your losses.

    If unhappy with response, then complain to Financial Ombudsman Service

      When you took out the RAC Breakdown cover, did they ask you if you had 'disabilities'?

      I think they should be giving 'priority' call out (even if you weren't asked to disclose at the
      time you took it out).

      16 hours is 'ridiculous'; o.k. I know we have 'exceptional' weather conditions etc.

        Can't remember if I was asked at the time. I certainly mentioned it about 5 times over the weekend.

          Once you told them you were a 'Blue Badge' holder and disabled they should of 'prioritized' you.
          Do as Des8 says, formal compliant, follow complaints procedure on their website. Somewhere
          on their website will be documented what service they provide for 'vulnerable customers'.
          They clearly failed to do that in your case.

            Interestingly been contacted directly by RAC customer care team.
            They've offered me compensation at the rate of £350 a day - 2 days so £700.

            Hmm. I lost out on the event I was going to - that's £200 to start. Got home sunday and felt really ill - only today have I felt back to normal.

            Told them I'd need to speak to my legal representative (not got one of course). Hour later he's phoning again asking me for my bank details to pay this £700.
            I said whoa now I haven't agreed - as before I need to speak to legal rep. Then he wants to know when, admits if might be negotiable, and wants to schedule in call for tomorrow am.

            Got massive impression they are keen to make this go away.

              I suggest that you add up all your outlay (hotel, uber etc) , together with the cost of the ticket for the event you missed. Add in something for the disappointment of missing the event. Add general compensation for the dreadful (lack of) service. I reckon you can increase that figure quite a bit.

                Those things easy to calculate.

                What sort of figure though for disappointment? (One date in the UK so I can possibly never go again).

                And what about the physical discomfort thing of being left in the heat, limited foot/water, no toilet facilites? Any idea what a reasonable figure would be?

                (If I'm honest, it did make me ill. I'm not the youngest but its taken me a day or two to get over it)

                  It's hard to say. Maybe aim high, and see if you can sense where the limit of the guy's authority is.

                  My tip - don't split the difference. Rather than meet half way, go down a relatively small amount, say 10%. Do this until you sense he can go no further.

                    Thanks. I've actually got media interest now as well which I'm guessing the RAC won't want to see....

                      Aim high? Is high double what they offered? 10x? I don't want to quote a figure that shows a complete lack of common sense?
