Missing parcel delivery

  • Missing parcel delivery

    I had a parcel delivered to a safe place by royal mail, I have no designated safe space as my house is a busy footfall area near 2 schools. Royal mail email stated a signature is required and as I was at work I thought it would go to a neighbour or I would have to collect it, they left it in my green recycle box and the delivery guy signed for it. The company I bought it from are saying as royal mail have delivered it, they can not do any thing and have said I require a third party independent to take this further, googling this has given me no further information.
    Can anybody advise further, just to add it is £150 of clothing.

    So your saying Royal Mail shouldn't leave parcel in green recycling bin?

    Do your neighbours have CCTV cameras etc?

    Have you previously signed for parcels from Royal Mail?

    If so, that may prove that it's not your signature.

      So your saying Royal Mail shouldn't leave parcel in green recycling bin, That is correct, I have no safe place designated for royal mail.
      I have previously signed for Royal mail parcels. The delivery driver signed for it and left it in my green box.
      No cameras are available.

        See if you can track down those deliveries / signatures, compare signatures, etc send Royal Mail comparisons with Formal Complaint.

          Assuming the seller is a UK company they are wrong.

          You can quote s29(2) of the Consumer Rights Act 2015 to them:


          "29 Passing of risk

          (1)A sales contract is to be treated as including the following provisions as terms.

          (2)The goods remain at the trader's risk until they come into the physical possession of—

          (a)the consumer, or

          (b)a person identified by the consumer to take possession of the goods."




          Leaving a parcel in a green recycling box is clearly NOT delivering it into your "physical possession", so the seller remains liable either to replace it or to refund you. It matters not whether the seller left it in the green box or whther their agent Royal Mail did. The seller is responsible/

          Note also that the law does not recognise the concept of a "safe place" for delivery Goods either have to be delivered into the physical possession of the consumer or of a person identified by them to take possession. You can't identify a "safe place" to leave goods in.
