Council repossessed building with SD's car inside, they are being so obstructive-help

    This link confirms it is a criminal offence to describe yourself as a solicitor in your business communications if you are not on the register

    Initially I would ask the council to explain this apparent discrepancy. If not satisfied with their answer you have the the option of reporting it to the SRA.

    Note that calling themself a "lawyer" is not regulated, it is the use of the description "solicitor" that is controlled.

        Thank you for the information, have followed your advice and emailed the Chief Executive because they refuse to give me a contact for the "Head of Legal People".
        They have signed their name, from this I dont know gender but thats another matter, followed by the word Solicitor.

            A few hours after contacting the Chief Excutive I .got an email saying...

            "Thank you for your emails confirming both capacity and that full title of your Late fathers estate, has been passed to you.

            Concerning collection of the Jaguar, I have asked our estates team to liaise with you directly."

            At last a result, thank you echat11 and PallasAthena for your help and guidance with this.
            My email to the council’s Chief Executive has been passed on so we will see what the reply is and decide what, if any, action, we take on that.
            The "solicitor" information supplied will be very helpful with this.

            In a footnote, my SD's GP and the solicitor who handled her father's estate have described the council's solicitor's behaviour as disgusting and disgraceful

              Update...
              We have provided the information from the excutor and GP and this has been accepted by the council and we have now had access to the unit. This was a disaster!!!
              Most of the cars major items are missing-engine, gearbox, back axle assembly, seats, trim, roof, windscreen and numerous other parts.
              Council & bailiffs say their video/photographs, taken on entry, do not show any of these parts being there so I am waiting on a copy of the information to confirm they are right.
              If this is so, this horrible individual has either sold them or hidden them somewhere else.
              The police are investigating the whole situation and have been in contact. They are mentioning the amount of £800-£900,000 as an estimate so unless they know where his storage unit is and can therefore recover some of our parts, I think the phrase is "we are stuffed"!!!
              All we have is a painted E-Type body shell worth at most £20,000. Small change when you consider he has been paid £132,000.

              Apparently his house was also repossessed just after Christmas and his companies were all limited so no recourse there. Mortgage, 2nd mortgage and other loans against it

              Re the council's solicitor, they say she is a locum and therefore will not be shown on their site, however her LinkedIn account says she is a Senior Litigation Solicitor with XYZ council.
              She is registered with the SRA but uses an abbreviation of her Christian name when signing letters, rather misleading I think.

              A strongly worded complaint is in the post to the Council's Chief Executive regarding her conduct concluding with 14 days or else....

                      It means that while we have been trying to get access for 3 months they have allowed others to remove our property from the unit-due diligence?

                      Still trying to view the pictures or video but no one wants to provide a copy, except the bailiffs who want £168 for it.

                      Re the Christian name, an example at the end of an official email could be something like Maz Smith, printed or signed, but underneath, printed or otherwise it should say Malcolm Smith. Otherwise you could never check on Maz Smith’s registration and he could be anybody.

                        If you sue, you will have to do the proving, in this case that the items were there at all material times.

                          Once we have the video and pictures taken at the time of repossession, we will have proof if they were there or not. There are three parties that have this information, the council, bailiffs and Police. I have asked all of them for a copy. The bailiffs want £168, the council haven't replied yet and the police are taking advice to see if they can give me access to what maybe future evidence.

                          If the missing parts appear in the video or pictures I would think that would be proof enough that the council or their agents, are responsible for their disappearance.
                          I assume that would be sufficient.
