  • Faulty appliance - stuck with repairer

    I bought an appliance back in January, not from the manufacturer direct, but from an authorized retailer.

    It developed a fault (first in May, but it resurfaced in October) and I contacted the place I bought it from and asked if they would take it back as defective.

    They said no, they can only take it back within the first 30 days, and I would have to contact the manufacturer.

    I did this, and they arranged for it to be taken in for repair by a third-party company. They picked it up in a van and took it in.

    It took them at least two weeks for them to even start looking at it. They now say they have reproduced the fault, but I have been without it for 4 weeks now, and I am losing patience.


    What further steps can I take to force them into action?


    Normally I would request a chargeback to my credit card but the original transaction was with the retailer, and they're not the ones who've taken it in for repair. So it seems a little tenuous to claim off them, although they were the ones who told me to contact the manufacturer.


    What, hypothetically, could I do if I simply wanted my property back whether they can repair it or not?

    You're covered by the Consumer Rights Act 2015,

    The goods is still under warranty.

    Providing the goods cost over £100, the purchase is still covered under Section 75 under the CCA 1974.

    So the retailer is still liable, they sold it to you, it's faulty.

    Asking you to contact the manufacturer, when they are still 'liable' for a faulty goods isn't great.

    Contact your Credit Card provider, lodge a Section 75 claim, do it in writing.

    Lodge a complaint with the retailer.
