  • Who was robbed?

I have just had a "VARS" notice for driving away without paying £39.99 for diesel at a shell/Asda fuel station 5 weeks ago.
    I paid with 2 x £20 notes but didn't get a receipt.
I have heard stories that the employees are aware that the CCTV is "recycled" monthly and VARS takes longer to produce the claim letter and obviously they know you paid with cash, have no receipt and are therefore likely to roll over and pay up, so stealing has become rife.

My question if anyone can help.
I am contemplating a defence to this claim by accusing the shop assistant of theft....but are they stealing from me or the company they work for?
If the money (as I suspect) never made it into the till and the sale was not completed (i simply handed the money to the clerk, turned around and left) who was robbed?

    Thanks in advance.

    Hi BobbyB

    Welcome to LB

Lodge a formal complaint against the branch / employee, send it to their H/O in writing.
You will be up against it evidence wise, but you need to make them aware, that
this has happened. Give them as much detail as possible, i.e. where the employees
were during your transaction, other customers, was there a queue, that made you
not want to hang about etc.

Send it to: Asda House, South Bank, Great Wilson Street, Leeds, LS11 5AD

Don't accuse an employee of theft unless you have at least some evidence. You have none. Making theft accusation won't help, stick to the facts.

That's exactly what the OP is saying, he paid cash, left quickly, what evidence do you think the OP can 'conjure up'?

I'm sure the company will deal with the matter 'delicately'.

He can say that without making an accusation.

Always get receipts. Especially when paying by cash and even more especially when paying by cash at a filling station...

I don't suppose OP can produce evidence that the shop assistant stole his money which is why he shouldn't make the accusation!

The absence of evidence of what happened to OP's money is not evidence that the shop assistant stole it.

I entered the petrol station, I handed the employee 2 x £20, there was a queue, so left without my receipt.
I have now received a VARS Notice when payment was made to the employee at the Point of Sale.
It's stating his facts, it's for Asda to investigate or not to investigate.

                  That's good advice to OP.

However what OP said, and which prompted my advice, was "I am contemplating a defence to this claim by accusing the shop assistant of theft".
