  • Hidden car fault

    Hello all, maybe here someone could help me.
    ●I bought car, from business, Ltd, on Ebay. On 26.10.24. Volvo s80, 113k miles £3700
    ● listing was ended ,seller didn't marked as sold ,only deposit was taken
    ●description was car in good condition, no faults, driving smooth(automatic gearbox)
    ●I have signed sales agreement, also bought car warranty for repairs recommended by seller- he signed me, and on top of the car price I paid for the warranty
    ●on testing drive I mentioned to seller that I got impression that car jerks when I start the motor, for example on the road cross waiting on lights, when moving I felt that jerk and he said it's normal because I need to use to drive the automatic car
    ●I come back to home, 2.5 h on motorway, drive was ok,smooth
    ● during last few weeks, just driving home to work, daily commute, shopping etc, -The car still jerks when starting, -I can hear noise in the gearbox
    -I get the impression that the gearbox is an excessive load on the engine, which results in slower acceleration
    I went to garage for check the car, no computer fault, car was on testing drive by the garage, lifted up, checked gearbox oil which turned up that is smelly, very dirty with metal shrinks in it.
    I have been told that this fault did not happen just now, but it's from longer time, before I bought the car.
    I got advice for gearbox recognition cost £3k +Vat or change for new for £7k , do not drive longer distances.
    I contacted the seller on 26 November saying about the problems. He refusing, saying change oil in gearbox , it should help. That the price of this job is ridiculous. He wanted to me bring car back to him, leave car for few days, its not his fault that I live 2.5 hr drive from him. He pushed me to use the warranty. I went to another garage, the same diagnosis as previous. I paid another £56 for diagnosis. Warranty only cover up to £1k for new faults and not existing. Now momentum warranty wants me to go to garage, strip put the gearbox, for photos, videos and price for broken parts. Car need to be in a garage for a day or two, I have to pay £190 +vat.
    I need help with advice for my rights. I just bought car in good faith, seller just lied to me. He don't want to take this car back.... what can I do?
