echat11 they have sent me director questionnaire they have tickedd to determination withit hearing. My main defence is the default notice never being served to me as such this is unenforceable. Can I still make counterclaim or if I win the case I can claim for cost like all this time I have been spending time on this case when I told them for years that without default this is unenforceable and they wasting mine and court time.

but you would need to set out clear reasons for the Counterclaim and you would need evidence.
Your court fees and reasonable expenses like travel and loss of earnings for yourself can be recovered.
You can't claim for stress or the hassle this has caused you.

echat11 hi i assumed 28 days have passed and i haven't heard nothing from court. Just a correspondence from overdale regadding the offer for full and final offer i sent then my full and final iffer of £50 without prejudice just if they wanted to recover their court fees and call it a day if I haven't received anything from court is it safe to assumed it's stayed now? Or will i recieve a letter from court confirming the case is stayed ? I sent them without prejudice full and final offer of £50 just sp to finish this thing off and I mentioned 14 days window for them to accept 1 week is gone and 1 week left.

If you are in doubt, it's always best to ring the Court, the offer to settle has been made outside of the Court Procedures,
might be relevant after the Hearing / Judgement case.
You will receive a DQ (update when you get that). So providing they've followed CPR, there shouldn't be any issues.
But make a note of anything you think is wrong on the Claimant's part
