  • Car developed a fault within 30 days

    Hi all

    First time buying a used car from a trader and it has a fault. Bought a BMW 320d for 27000 on the 15/12/22. Within the first few days I notices the functionality of the passenger wing mirror has failed. I informed the dealer who asked me to get it booked in and go through the rac warranty. Due to a relatively minor fault. I thought I would get it booked in the next few weeks due to how busy our local garage are and let the dealer know the outcome. If warranty payed out then great

    However. When driving home last night 3/1/23. I had my music off (usually listen to music when driving) and heard a fairly loud whine from the front. Specifically when the turbo kicked in. I took it to a local BMW specialist who drove the car and said it definitely sounds like the turbo and no a characteristic of the car. I can't say I have heard this sound before whilst owning the car

    As I have had the car for less than 30 days. What are my rights with the trader?

    The Consumer Rights Act 2015 gives you the right to ask for a full refund in the first 30 days after buying any product that proves to be faulty, including a new or used car. The law also provides protection for servicing and repair work that renders your car faulty.

      The trader has asked me to have the issue diagnosed by a local specialist, as the trader is a fair bit of distance away from me. He assured me if the issue is the turbo. He will ensure it is resolved.

      What confuses me is that some places state that I need to prove the fault was there before I purchased the car. The car didn't make the sound at the time of purchase and only occurred last night. Does this mean I'm not liable for a repair or refund?

        Market no difference a fault has occurred within 30 days get refund or if they state repair which way is your choice. Up to you?

          Thank you Mike. I would prefer the car to be repaired. What would the course of action be if the trader refuses to repair/refund?

              They did say If there is a fault with the car they would repair it. Just curious. I'm taking it to a local specialist for diagnostic. If the trader suggests that the specialist local to me repairs the car and they pay for it... Where do I stand if the repair does not resolve the issue.. As its a garage I have taken it too for repair? Or would it best for me to drop it off at the trader to repair?
