      I had high court enforcement chasing and got a charging order. If nothing else it willl annoy the hell out of the debtor...

        I managed to get an update from the HCEO. Although it's been with them for weeks / months now they are yet to make a visit to the debtor. I'm somewhat disappointed with this really not just because of how long this has been going on for (judgement was made in December) but more because it's giving the guy masses of time to do all he can to avoid paying.

            I've been looking into this today.

            It appears that I need to complete Form N379. There is also the option of an attachment of earnings or a third party debt order.

            All these forms ask for details about the defendant which I don't know i.e. address, bank details etc. Working through finding a way to obtain this information.

              Is an address shown on Companies House website in respect of any company of which he is director?
              Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

                  You should not need bank details for a charging order just his deeds (get from land registry) but you will need an address

                    By way of another update.

                    Enforcement agents visited the property and gave the Debtor 24hours to pay.

                    I have since been notified by the Debtor that they are now on 'breathing space'.

                    Unsure where to go from here.

                        So far all I have had is an email from the Debtor with a reference number.

                        I have contacted the debt advice provider asking them to confirm the reference number is correct and that, if so, I wish to dispute the Breathing Space application.

                        The enforcement agents were also given the same reference number / email screenshot and sent this to me asking if I had seen it and how I wished to proceed.

                              Yes, because if you have not received any notification which may have been sent you, it might be deemed that without proof of non delivery, you have received it.
                              When a debt is included in the scheme the creditor has to abide by the rules from the date of receipt, or deemed receipt.

                                I have contacted the Debt Advisor to try and get some more information.

                                Struggling to see how I am not prejudiced against given I am an individual (not a business / organisation) who is enduring financial hardship themselves in terms of servicing the debt that is owed to me.
