  • Motor Insurance Legal Costs Cover Query

Hi I had legal cover added to my Fully Comp M/Bike insurance. Following a serious accident 3 years ago I've had to change solicitor. The previous solicitor is looking £1200 before he releases my file.
My question is, should my legal expenses policy cover this cost? Even though the case is now 3 years old, this policy should cover the accident as I was insured at that time?
    Any help would be appreciated.

You need to look at the terms of your policy to see what it does and does not cover. Most policies require you to claim promptly, and I would be concerned that you have left it much too late.

You should also look at the terms of your engagement with the solicitor to see whether they are entitled (a) to raise this charge and (b) to retain papers until paid.

Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Yes its following on from the post you linked. The solicitor has not replied to my SAR request.
I have now found a solicitor who will be taking over this case.
The process of getting my files from him is now in place.
