    Didn't ever read/realise the above - discontinued a small claim last year with the intention of starting it again.

    Will the above be a problem do you think?

    Yes, the Civil Procedure Rules are there for a purpose, and judges do tend to follow and apply them wherever possible.

      Is part 38 a relatively new rule? Anyone know?

        Part 38 has been with us since the CPR were introduced in 1998. Before that there were predecessor rules to much the same effect.
