  • Used car purchased under 2 weeks issues

Hello all I am hoping to get some advice, I purchased a used vehicle from an independent dealer on the 16.10.2021 I had it booked in to a dealer for a service and inspection as it is a 13 year old lexus hybrid to be fully checked at a cost to me, after the dealers inspection they have highlighted some. Worrying issues costing some considerable money, shock absorbers split radiator leaking air conditioner condenser leaking and the suspension arm bushing Severely deterioted brake caliper passenger rear is seized amongst other items, when mentioned to the dealer they're response "it has just been MOTd this was in June and other professional have said at least the shock absorbers and suspension bushings should have picked up as the dealer provided a video and they said that they would have been just as bad, I know this is just an opinion, furthermore I have been doing this via email and also requesting read and delivered receipts and also the company WhatsApp number, they also advised me to speak to the warranty company who are not governed if that is the correct word but underwrite there own warranties I initially paid for an extended warranty but realised it is not worth the paper written on and took the free 3 months warranty, I have made preliminary enquiries to the warranty company without a registration and they have said go to any vat registered garage and ask them to call I bought the car in Leeds and live in North London the 4 independent garages that we use as a family and trust said they would not get involved with the warranty company and furthermore the suspension arms seem very difficult to get and seem to be a dealer part only but the warranty company also said not to go to the main dealer as they always charge too much when other garages have been shown the quote they have said it seems reasonable further more I would feel safer for the main dealer to do the work but I have since written to the dealer last Thursday today being the 3rd of November 2021 siting that I am not happy and the vehicle is unsatisfactory and that they are more than welcome to other a resulotion weather it be them obtaining authorisation from the warranty company and covering the shortfall in my behalf in the letter I asked to be kept in the loop today I sent an email asking for an update and it was delivered and read within minutes but no reply I can also see the what's apps are being delivered but not read, my main concern is I have until the 16th November to reject the vehicle or do I make a section 75 claim as I paid part of it on my credit card and then place a small claims court for the repairs as I said I am happy for the repairs to be carried out at the main dealer but not sure what or how I should go about this, I do have home insurance with legal cover but I can see it could be ok for me to place a small claims court online but it seems the garage is also ignoring me like they are waiting for this date to pass and also the two directors on company house are Martin and Timothy but when I call I get told Tom is dealing with it and Michael handled the sale I feel like I am being given the run around and my other concern is that on the sales invoice they out 95k miles when in fact it had 95600 miles and they are ignoring me.

I really do appreciate any advice or assistance as this is causing a lot of issues within the household as I have an elderly disabled mother and a mentally ill sibling to take to appointments and furthermore my other vehicle is not ULEZ complaint hence the purchase.

    Hi Raj

You are covered by the Consumer Credit Act 2015.

Contact your Credit Card provider, ask to lodge a Section 75 claim (tell them you want to claim consequential losses - all the costs besides the cost of the car). Provide them with a full summary with evidence / reports / emails etc. You are essentially building a case to get the best result - refund / all costs.

Send the Credit Card provider the following template, make sure you get Proof of Postage (the Credit Card company will play 'hardball' but persist -

Sorry, but I don't read solid blocks of text.
Perhaps you could break your post down into paragraphs?
Looks at a quick skim as if you have the right to reject the vehicle outright, or request the trader repairs it.
Your rights are set out in the Consumer Rights act 2015 (https://www.legislation.gov.uk/ukpga...ntents/enacted)
