  • VT help

    I’m having a major issue trying to voluntary terminate my agreement with my finance company.

    I got my used car in 2017 and a few months in I had some financial problems and couldn’t make payments for a few months. I eventually cleared all the outstanding money owed and carried on with my monthly payments.

    In early 2020 I requested a voluntary termination of my agreement as I had cleared over 50% of the amount payable but was told my agreement had been terminated in 2017 when I missed a couple of payments but I was unaware of this.

    I am due in court in a few weeks over this and would appreciate any help

      Sorry, I'm afraid I can't help as it is far too late in proceedings.

      If you have court in a few weeks you have obviously submitted your defence and witness statement so you will have to argue your case based on what you have submitted to the court.

        What do their T & C's say regards 'missed payments', rectifying the missed payments etc?
        You need to go through the T & C's with a fine tooth-comb.

          Hi

          thanks for the reply, the finance company have taken it to court as I cancelled my direct debit after they refused my VT. I haven’t submitted any statements or defence.

            You know you have a certain amount of time to submit a Defence and Witness statement. Are there any circumstances you can think of why you haven't? i.e. health, etc.

            Also ring up the court, find out if a Default Judgement has been made against you.

              I only found out I was due in court when I phoned up the other day to offer a settlement which they refused saying they would only accept the full amount owed.

              Im trying to find out details of where the court is and times etc.

                Have you received any court documents in the post?

                  Something doesn't quite add up.

                  How did you find out about the court hearing? There would have been a number of letters from the finance company way before it ended up in court and even then the court would have issued several letters/forms out to you. Are you saying you received none of this but all of sudden received information from the court that there is a hearing due soon?

                  Has this been a case of you burying your head in the sand or you genuinely didn't receive the letters? It would seem odd that you only received notification from the court about the hearing date but nothing else unless the court failed to send out multiple letters to you which I guess is possible but unlikely.

                    I genuinely haven’t received any court letters, I got a letter off the finance company saying I had 14 days to return the car to them and sign a voluntary surrender or they would start court proceedings against me.

                    when I phoned the finance company last week to offer a settlement they informed me that I was due in court. I haven’t had a single letter from the courts.

                    I’m still trying to get all the details for court time/location etc
